I’m wanting to start a conversation about the companies who have started selling software to vets to enable them to obtain/track consent from veterinary clients to make sure they are still happy to receive reminders etc. GDPR makes it clear that new clients have to proactively opt-in to such services moving forwards. But it is less clear about existing clients. In fact, GDPR refers to ‘soft opt-ins’ where consent is not required if you are sending marketing messages to existing customers related to similar products and services they have previously received. You needed to have given them the opportunity to opt-out at the outset when you first received their contact details (e.g. at registration) and you need to give them the continued opportunity to opt-out when sending subsequent messages. But otherwise, this effectively removes the need to get retrospective consent. What approach are you all taking? Are practices rushing to seek retrospective consent to continue to receive reminders? If so, are you employing one of the many software systems designed to do this?
Thanks @paul-walden and @dougalexander. GDPR interpretation varies considerably. I know plenty of practices are applying it to the letter whereas others are taking a more ‘wait and see’ approach. Can I ask anybody who is seeking consent from existing customers about their rationale?
I was told by a solicitor dealing in this area that you do not need explicit consent from any client to send them reminders or even marketing materials provided they are directly related to their animal. There has to be a way for clients to opt-out if they request it, but otherwise consent is implicit for any client, existing or new, if they register for your services.
